Empowering the People, Institutionalizing Accountability — The Living Mechanism of Democratic Nepal


Article 1: Introduction and Constitutional Relevance

In accordance with the principles laid out in The Unamendable Foundation of Nepal, the People’s Representative Assembly (PRA) stands as the primary legislative organ of the Federal Democratic Republic of Nepal, directly elected by the sovereign citizens of the nation every five years. It functions within the broader framework of the Constitution of Nepal and serves as a bridge between the governed and the governing bodies.

The Assembly's role is foundational in shaping laws, monitoring governance, and defending public interest through structured oversight and transparent democratic process.


Article 2: Constitutional Authority and Term

  • The PRA derives its legitimacy from the Constitution of Nepal and operates as per the provisions laid out under Part 6, Article 83–Article 105 of the Constitution.
  • It is elected through direct adult suffrage with mixed electoral systems ensuring representation from all groups.
  • The term of each elected Assembly is five years unless dissolved earlier under constitutional grounds.

Article 3: Core Functions and Responsibilities

The PRA is empowered with the following key responsibilities:

3.1: Legislative Authority

  • Drafts, debates, and passes national laws and amendments
  • Ensures consistency of all legislation with the Unamendable Foundation and Constitutional principles

3.2: Policy Approval and Oversight

  • Reviews and approves operational policies of national constitutional bodies including:
    • Judiciary (Supreme Court)
    • Anti-Corruption Bureau
    • Election Commission
    • Nepalese Army
    • Governance Evaluation Committee

3.3: National Budget and Financial Oversight

  • Approves the annual national budget
  • Reviews expenditures, public investments, and national borrowing

3.4: Ministerial Vetting and Appointment Procedure

No individual, even after being elected, may assume a ministerial post unless:

  1. Cleared by the Anti-Corruption Bureau
  2. Cleared by the Election Commission
  3. Receives national security clearance from the Nepalese Army
  4. Reviewed by the Governance Evaluation Committee for past work integrity
  5. Judicially cleared by the Supreme Court
  6. Endorsed by majority vote of PRA members

Article 4: Code of Conduct

4.1: Ethical Commitment

  • PRA members shall act with integrity, impartiality, and patriotism.
  • No member shall use their position for personal or partisan gain.

4.2: Public Decorum

  • All members must maintain discipline and decorum during Assembly sessions.
  • Use of abusive language, physical misconduct, or disruption of proceedings will result in disciplinary action.

4.3: Conflict of Interest

  • Members shall disclose financial or political interests that may affect legislative judgment.
  • Undisclosed conflicts will be subject to censure or suspension.

4.4: Anti-Corruption Pledge

  • Every member shall submit an annual declaration of assets.
  • Bribery, favouritism, and misuse of influence are criminal offenses under Assembly law.

4.5: Attendance and Participation

  • Members must attend at least 80% of sessions annually unless exempted by health or national duty.
  • Repeated absenteeism without cause may trigger expulsion proceedings.

Article 5: Operational Policy of the PRA

5.1: Committee Structure

  • The PRA shall function through structured committees including:
    • Law and Justice Committee
    • Finance and Budget Committee
    • Ethics and Conduct Committee
    • Oversight and Accountability Committee
    • National Security and Foreign Affairs Committee

5.2: Transparency and Public Access

  • All legislative debates shall be publicly documented and published.
  • Media access and public observers are allowed unless in emergency classified sessions.

5.3: Policy Implementation Review

  • Every policy ratified by the PRA will be reviewed annually for implementation effectiveness.
  • Failure of government departments to comply will result in summons for clarification.

5.4: Citizen Petition Handling

  • Citizens may file petitions regarding national issues or legislative proposals.
  • Petitions with 10,000+ verified signatures must be debated within 45 days of filing.

5.5: Digital Assembly Platform

  • All voting, attendance, and documentation shall be stored on a secure blockchain-backed digital platform for transparency.

Article 6: Emergency Oversight and Intervention

  • In case of institutional failure, national crisis, or collapse of governance, the PRA shall convene under emergency authority to:
    • Review and replace faulty structures
    • Establish temporary supervisory councils
    • Reinforce Unamendable Principles through legal instruments

This clause ensures continuity and protection of democratic functions under exceptional circumstances.


Article 7: Relation to the Unamendable Foundation

The PRA is the executing organ of the Unamendable Foundation of Nepal, which upholds national sovereignty, people’s interests, and ethical governance.

As outlined in the Foundation:

“Every law, every office, every power shall serve this foundation — not the other way around.”

The PRA ensures all pillars of state — Judiciary, Army, Executive, and Civil Services — operate in a system of mutual accountability and shared commitment to public service.


Article 8: Citizens and Their Role

  • Every Nepali citizen aged 18 and above has the right to vote and participate in national elections.
  • Citizens have the right to:
    • Petition the Assembly
    • Observe public proceedings
    • Demand audits and legislative review

Civic awareness, active participation, and constructive dissent form the lifeblood of the Assembly’s legitimacy.


Article 9: Final Declaration

The People’s Representative Assembly of Nepal is not merely a body of representatives. It is an institution of public guardianship. Through checks, transparency, and structured participation, it protects the very ideals upon which Nepal stands.

Let the Assembly speak with reason. Let it vote with conscience. Let it stand with the people.
