🔰 Introduction: The Soul That Binds the Nation
If the People are the body and the
Representative Assembly the voice, then the Constitution of Nepal is the
heartbeat — silently guiding, pumping life into every organ of national
governance. It is not merely a legal manuscript; it is the living covenant
between the land, its history, and its people.
Born from centuries of aspiration
and struggle, forged in the fire of revolution, and sanctified by the dreams of
every citizen, the Constitution does more than govern — it protects, it unites,
it inspires.
Nepal’s Constitution stands as Pillar
No. 3 of the Unamendable Foundation — the most sacred and immovable
force of the republic. This document upholds not only our laws but also our
shared values, intergenerational hopes, and collective dignity.
📘 Article 1: Code of Conduct – Constitution of Nepal
🔹 1.1: Supremacy of the
Constitution
- The Constitution shall be regarded as the highest
law of the land. No law, executive decision, military directive, or
judicial ruling shall contradict or override its provisions.
- All national and local decisions must strictly
align with both the letter and spirit of the Constitution and the Unamendable
Foundation, or they shall be rendered null and void.
🔹 1.2: Uniform Adherence
- Every institution, including ministries, courts,
the armed forces, and public corporations, must function within
constitutional limits.
- Violations constitute constitutional misconduct
and shall invoke immediate disciplinary, legal, or judicial proceedings.
🔹 1.3: Amendment
Limitations
- Amendments may not alter the core identity of
Nepal as an independent, sovereign, and democratic republic.
- Inviolable values include national sovereignty,
human dignity, universal equality, secular cultural harmony, and rule of
law.
- Amendment protocol shall require:
- A 75% supermajority approval in the
People’s Representative Assembly
- Judicial clearance by the Supreme Court for
compatibility with the Unamendable Foundation
- Ratification through a national referendum,
with a simple majority of registered voters
🔹 1.4: Integrity Clause
- Any attempt by internal or external actors to
annul, suspend, rewrite, or suppress the Constitution in part or in full
shall be treated as an act of high treason against the Republic.
- Such matters shall fall under the jurisdiction of Emergency
Constitutional Law, with priority hearings by the Supreme Court and
oversight by the People's Assembly.
⚙️ Article 2: Operational Policy – Constitution of Nepal
🔸 2.1: Constitutional
Guardianship
- The Supreme Court of Nepal shall serve as
the guardian, interpreter, and custodian of the Constitution.
- All legislative, executive, and judicial frameworks
— from central government to local charters — must trace their legal
validity to constitutional authority.
🔸 2.2: Accessibility and
Awareness
- The Constitution shall be published and distributed
in:
- All official languages
- Audio-visual, braille, and simplified formats for
inclusivity
- Digital platforms accessible without restriction
- National Constitution Day shall be observed
annually with educational initiatives, public forums, and awareness
campaigns in schools, universities, and communities.
🔸 2.3: Constitutional
Review Mechanism
- A Permanent Constitutional Monitoring Authority
(PCMA) shall be established with the following mandates:
- Conduct annual reviews of all laws and policies
for constitutional compliance
- Submit public reports to the Supreme Court and
People’s Representative Assembly
- Investigate petitions filed by citizens regarding
constitutional violations
- Recommend corrective legislative or judicial
actions
🔸 2.4: Crisis Clause –
Emergency Continuity Protocol
- In the event of national emergency, armed conflict,
or collapse of civilian governance, a Joint Emergency Constitutional
Panel (JECP) composed of representatives from:
- The Supreme Court (3 members)
- The People’s Representative Assembly (3 members)
- The Head of State (1 delegate)
shall be empowered to:
- Interpret or suspend only secondary and
procedural clauses for national survival
- Invoke transitional governance mechanisms
- Ensure protection of core, inviolable principles,
including the Unamendable Foundation, fundamental rights, and sovereignty

The Constitution is not a relic of
legal tradition — it is the soul of Nepal’s democracy. It lives within
the aspirations of every child who dreams of freedom, every farmer who labors
for dignity, every soldier who stands for honor, and every citizen who casts a
vote.
It is not a tool for the ruling;
it is a shield for the ruled. It does not exist to glorify governments,
but to guard generations.

🖋️Ratified for the Nepal's Review, in conquest of the new appeal to change
the system from grassroot level, who believes, a strong foundation, a
structured and well written system of policies and codes, along with their
implementation is necessary for this level of changes. Who also believes, no
changes can be made overnight, for this level of change, one must touch the
heart of every national and uphold a system by leading them through a times of
struggles.
A thought of a country men is always the betterment of
its country and nothing more, there can be more ideas and improvement
opportunities, when people join and lead the way for the betterment of a nation
and its values.
Hence, this is just one of the simple ideas from the
simple son of a mother "Nepal".
